Rental Terms & Conditions

Arkilamo is a marketplace. The rental agreement is between the renter and vehicle owner; Arkilamo provides separate platform services.

1. Operator, scope and acceptance

Arkilamo is operated by WebRepublik IT Solutions, with its business address at Bacoor, Cavite, Philippines. Contact customer support at support@arkilamo.com. These terms govern use of the website, progressive web app, accounts, listings, booking tools, messaging, payment facilitation and related platform services. The booking-specific agreement also identifies the vehicle owner and renter.

By creating an account or completing an enabled booking, you agree to the version presented for that action. Browsing does not create a vehicle rental. The Privacy Notice explains data processing; consent for sensitive identity captures and optional communications is obtained separately. Mandatory rights under Philippine law are not waived.

2. The marketplace and the rental parties

Arkilamo connects vehicle owners or their authorized rental businesses with renters. Unless a booking expressly and lawfully states otherwise, Arkilamo does not own, lease out, possess, maintain, inspect as a licensed inspector, or operate the listed vehicles, and is not the renter’s vehicle owner, insurer, driver, employer of the driver, or transport operator.

The vehicle owner and renter enter the vehicle rental agreement with each other. For a with-driver booking, the owner is responsible for supplying and lawfully engaging the driver and for the driver’s qualifications, permits and conduct. No employment or agency relationship is created merely by using the marketplace. Actual legal relationships remain subject to the facts and applicable law.

Arkilamo separately supplies its own marketplace services, may collect its disclosed fees and facilitate payments, and remains responsible for its own acts, representations, data processing and obligations imposed by law. Calling Arkilamo a marketplace does not remove liability that legislation places on an e-marketplace or digital platform.

3. Eligibility and account security

Account holders must be at least 18 and legally able to contract. Driving eligibility may require a higher age, minimum licence tenure or other lawful conditions stated by the owner or insurer before booking. A valid licence for the vehicle and all authorized drivers is required for self-drive use.

Provide accurate legal names, contact details and residential address, and keep them current. Do not impersonate another person, buy or lend an account, submit fabricated documents or allow an unauthorized person to use a verified account. Protect passwords and report suspected compromise through support. Owners must have lawful authority to offer the vehicle and enter the rental agreement.

4. Identity, vehicle documents and verification limits

Renters and owners must complete the required identity process, including two distinct valid government IDs, camera capture, a selfie and the requested live-camera challenge. Owners must also provide the vehicle’s OR/CR, current TPL and comprehensive insurance documents, and photographs of the front, rear, left, right and interior. Additional lawful checks may be required for particular vehicles or incidents.

Document information, names, plate numbers and dates may be extracted and checked with AI assistance. AI flags, a submitted selfie, a camera challenge and a verification badge are not government certification, a guarantee of authenticity, reliable biometric liveness certification, insurance approval or a guarantee of future conduct. Human review and additional evidence may be required.

Do not rely on ordinary comprehensive or TPL documents as proof that commercial rental, every driver, every location or every incident is covered. The owner must obtain the actual insurer’s written rental-use coverage where required, disclose exclusions and deductibles, and ensure current valid documents. The renter should review the applicable policy terms before accepting the rental.

5. Listings, availability and booking formation

Owners are responsible for truthful descriptions, current photographs, lawful ownership/authority, roadworthiness, maintenance, registration, permits, rates, availability and insurance representations. Do not use stock photographs as photographs of the actual offered vehicle.

A search result, quote, saved vehicle, payment redirect or unconfirmed request is not a completed rental reservation. A booking is formed only when the platform displays the applicable confirmed status and the required parties have accepted the rental terms. The owner must not substitute a different vehicle or materially change a confirmed price or package without the renter’s informed agreement through the platform.

Only enabled features can be used. A policy describing an optional payment, wallet, rewards or tracking feature does not mean that feature is active on every account. If bookings are disabled or a payment is pending, no live rental or successful payment should be inferred.

6. Self-drive and with-driver packages

Owners may offer self-drive, with driver, or both at different full daily rates. The selected mode and applicable price must be visible before confirmation. With-driver packages must state included service hours and the treatment of fuel, tolls, parking, driver meals and lodging, overtime, excess distance, waiting, additional stops, collection/drop-off, out-of-area travel, ferry/RORO, terminal fees, holiday/night charges and special equipment.

Included, excluded and not-applicable labels form part of the displayed package. Any excluded fee must have an agreed amount, calculation or actual-cost limit before it is incurred. Suggestions supplied by the system are starting points that the owner must review; they do not create insurance coverage or make an unpriced fee automatically payable. Material changes require fresh agreement. The terms recorded with the booking take precedence over later listing edits.

7. Charges, platform commission and payment facilitation

The checkout or booking summary must itemize rental charges, refundable deposits, taxes where applicable, optional agreed charges and provider fees. Arkilamo’s owner commission defaults to 20% of the eligible rental subtotal unless a different rate is disclosed and agreed for that booking. Deposits and separately stated payment-provider fees are not rental revenue for this commission calculation. A later commission change does not retrospectively change an existing confirmed booking.

Online payment is facilitated through PayMongo when enabled. PayMongo’s available methods, verification requirements, processing times and applicable terms also apply. Where the pass-on fee feature is enabled and permitted, the payment-method-specific fee is shown by PayMongo before payment; it must not be represented as a fixed universal rate. Do not send card credentials, passwords or one-time codes in chat.

A redirect, success-page visit or screenshot is not proof of cleared payment. Arkilamo reconciles the provider’s server-side result. If a customer leaves checkout or returns to the app, the attempt may be marked cancelled or under reconciliation; a later verified payment must still be accounted for and, if the booking cannot be fulfilled, handled through the refund process. A payment must never be erased merely because the browser returned.

Where cash booking and owner wallets are enabled, the renter pays the owner the agreed amount and the owner remains responsible for the platform commission. Commission may be reserved or deducted from the owner’s available platform balance under the disclosed rules. The owner must maintain sufficient funds and record the cash receipt. Do not falsely report a transaction as cash, cancelled or unpaid to avoid commission.

Wallet entries and pending earnings are not a bank deposit or a promise of immediate withdrawal. Availability depends on actual reconciliation, settlement, completion, lawful holds, account verification and supported payout rails. Bank/e-wallet credit times and fees must be disclosed; real-time payout is not guaranteed merely because a bank, GCash or Maya account has been nominated.

8. Deposits, cancellations and refunds

The Deposits & Cancellations policy forms part of these terms. A refundable deposit is separate from rental revenue. The booking must identify who holds it, its amount, permitted deductions and release process. A deposit is not automatically an insurance payment or a limit on a party’s lawful liability.

The cancellation schedule displayed before confirmation applies to that booking and cannot be worsened retrospectively. Refunds, provider fees and deposit claims must be assessed under the agreed policy and applicable law. No term permits an unlawful blanket no-refund rule or denial of remedies for non-delivery, misleading services or other protected circumstances.

9. Handover, permitted use and return

The parties should record identity/driver authorization, the actual vehicle and plate, fuel/charge level, odometer, accessories, existing damage, pickup/return time and photographs in the agreed handover process. The renter must return the vehicle at the agreed place and time in its documented condition, allowing ordinary wear and tear.

Do not drive unlawfully, intoxicated or without the required licence, allow unauthorized drivers, exceed the agreed territory or capacity, use the vehicle for criminal activity, sub-rent it, race it or disable required safety equipment. Owners must disclose lawful restrictions before booking. A renter may decline an unsafe vehicle or an undisclosed material substitution and contact support immediately.

Owners remain responsible for lawful maintenance, registration and vehicle safety obligations. Drivers must comply with traffic rules and lawful rest/work requirements. An owner must not remotely immobilize a moving vehicle or use tracking to harass, stalk or unlawfully recover a vehicle.

10. In-platform communication and repeat transactions

Use Arkilamo booking messages, approved payment flows and rebooking tools for platform-introduced transactions. Do not solicit, advertise or arrange an off-platform substitute for an Arkilamo-introduced booking in order to evade fees, fraud controls, dispute records or agreed restrictions. This does not prohibit lawful emergency contact, legally required identification, protected reports to authorities or genuinely unrelated pre-existing relationships.

Phone/email/link sharing may be restricted in booking chat. Such controls are imperfect and do not guarantee prevention of offline contact. Keep material changes, extra-charge approvals and evidence in the platform. Do not harass, threaten, discriminate unlawfully, publish another person’s IDs, or request passwords/payment codes. Rewards apply only to qualifying in-platform activity under the disclosed programme rules.

11. Rewards and promotions

Where enabled, rewards are personal, non-transferable, non-cash benefits subject to the disclosed earning, redemption, cap and expiry rules. A tier or points balance is not an assurance of safety, creditworthiness or insurance coverage. Refunds, fraud or corrections may reverse points, including against future earnings if points were already spent.

Promotions cannot override mandatory consumer rights or an agreed cash refund. Programme changes apply prospectively with reasonable notice where required; they must not arbitrarily remove a vested benefit or change an existing booking’s agreed price.

12. Complaints, account restrictions and fair review

Use the Complaints & Appeals process for non-delivery, condition, charges, deposit deductions, payment issues, verification errors, privacy concerns or platform service concerns. Arkilamo can preserve records, request evidence and facilitate resolution, but does not replace courts, insurers, law enforcement or competent regulators.

Accounts/listings may be temporarily restricted for a documented safety, fraud, verification, payment or legal concern. Give notice and an explanation where lawful and safe, permit a response and appeal, and use proportionate measures. An account restriction does not automatically forfeit deposits or amounts lawfully owed. Urgent protection or legal requirements may justify action before notice.

13. Responsibility, limits and indemnity

Owners and renters are responsible for their own rental obligations, inaccurate statements, unlawful acts, negligence and damage for which they are legally liable. A third-party rental dispute does not by itself make Arkilamo the vehicle supplier. Arkilamo does not guarantee uninterrupted service, any user’s conduct or a vehicle’s condition merely by hosting a listing or carrying out checks.

To the extent permitted by law, Arkilamo is not responsible for losses caused solely by an owner, renter, driver, insurer, payment provider or event outside its reasonable control. It remains responsible to the extent its own actionable conduct contributes to the loss or liability is imposed by law. There is no exclusion for fraud, wilful misconduct, gross negligence, unlawful data processing, mandatory marketplace/consumer duties, or death/injury liability that cannot legally be excluded.

For non-statutory claims solely for ordinary breach of Arkilamo’s separate platform-service contract, a proposed aggregate cap is the greater of PHP10,000 and the platform-service fees paid by the claimant in the preceding twelve months, only where that cap is lawful, reasonable and enforceable. If a court finds it unfair or invalid, the applicable legal remedy prevails. This cap does not limit rental-party obligations or mandatory rights. The operator must have this clause reviewed for its actual business model.

A user who causes a third-party claim by fraud, unlawful use or material breach may be required to reimburse reasonably incurred, proven losses and costs to the extent attributable to that user and permitted by law. This does not indemnify Arkilamo for its own fault, remove a consumer’s defence, or permit uncontrolled automatic deductions. Give reasonable notice and an opportunity to respond to a claim.

14. Evidence, changes, governing law and contact

Keep booking, payment and handover records. Electronic acceptance records may evidence the terms agreed, without overriding the legal rules on consent or admissibility. Changes to platform terms will be dated and notified appropriately; a materially different term for an existing rental requires lawful consent.

Philippine law governs, subject to mandatory rules and competent authorities. Parties may seek an agreed resolution, but no clause forces a consumer to waive access to the DTI, National Privacy Commission, lawful small-claims procedures, courts with proper jurisdiction or other competent agencies. No exclusive venue term overrides mandatory venue rules.

If a provision is invalid, the remaining lawful provisions continue where possible. Contact support@arkilamo.com or the in-platform support inbox. Privacy matters may be sent to support@arkilamo.com. The operator’s published legal particulars are part of the contact section.
